Types of Information We Collect

Cypherly collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Cypherly’s purpose in collecting non-personally identifying information is to better understand how Cypherly’s visitors use its website. From time to time, Cypherly may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

Cypherly also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users. Cypherly only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.

Certain visitors to Cypherly’s Website choose to interact with Cypherly in ways that require Cypherly to gather personally-identifying information. The amount and type of information that Cypherly gathers depends on the nature of the interaction. Those whom engage in transactions with Cypherly are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, Cypherly collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Cypherly. Cypherly does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

Protection of Personal Information

Cypherly discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Cypherly’s behalf or to provide services available at Cypherly’s website, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Cypherly’s websites, you consent to the transfer of such information to them. Cypherly will not rent or sell potentially personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Cypherly discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Cypherly believes in good faith that disclosure is reasonably necessary to protect the property or rights of Cypherly, third parties or the public at large. If you are a registered user of a Cypherly website and have supplied your email address, Cypherly may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Cypherly and our products. If you send us a request (for example via a support email or via one of our contact forms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Cypherly takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns.

Cypherly uses cookies to help Cypherly identify and track visitors, their usage of Cypherly website, and their website access preferences. Cypherly visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Cypherly’s websites, with the drawback that certain features of Cypherly’s websites may not function properly without the aid of cookies.

Accessing Your Information

You can help ensure that your contact information and preferences are accurate, complete, and up to date by logging in to your account at Cypherly.io. For other personal information we hold, we will provide you with access for any purpose including to request that we correct the data if it is inaccurate or delete the data if we are not required to retain it by law or for legitimate business purposes. We may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law.

Privacy Policy Changes

Cypherly may change its Privacy Policy from time to time, and in Cypherly’s sole discretion. Cypherly encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

Release

You hereby release Cypherly, its directors, officers, employees and agents, from any and all claims and demands arising out of or in connection with such use of the Feedback and/or Testimonial and your name and/or likeness, including, but not limited to, any obligation to make any payment hereunder and from any other liability incurred in connection with the use of any Feedback and/or Testimonial or your name and/or likeness in the manner provided herein.  You further acknowledge and agree that this release is irrevocable and binding upon your heirs and assigns.

Subscriptions

Though some features of the services are free, or may be used for free during a promotional period of our choice, many features require you to purchase a subscription.

You agree that if you purchase a subscription, your subscription will automatically renew at the subscription period frequency referenced on your subscription page (or if not designated, then monthly), and your payment method will automatically be charged at the start of each new subscription period for the fees and taxes applicable to that period. To avoid future subscription charges, you must cancel your subscription 3 (three) days before the subscription period renewal date by emailing support@cypherly.io.

Except as expressly set forth in these Terms, payments for any subscriptions to the services are nonrefundable and there are no credits for partially used periods.

Payments

You agree to pay Cypherly any applicable fees posted for the services. By completing and submitting any credit card or other payment authorization through the services, you are authorizing Cypherly to charge the fees to the account you identify. You authorize and direct us to retain information about the payment method(s) associated with your account.

You must keep all billing information, including payment method, up-to-date. If we do not receive payment from your designated payment method or any other payment method on file, you agree to pay all amounts due upon demand by us. You will be responsible for accrued but unpaid charges, even if your account is canceled by you or terminated by us.  During any free trial or other promotion, if any, you will still be responsible for any purchases and surcharges incurred using your account.

After 30 days from the date of any unpaid charges, your fee-based Services will be deemed delinquent and we may terminate or suspend your account and Services for nonpayment. We reserve the right to assess an additional 1.5 percent late charge (or the highest amount allowed by law, whichever is lower) per month if your payment is more than 30 days past due and to use any lawful means to collect any unpaid charges. You are liable for any fees, including attorney and collection fees, incurred by us in our efforts to collect any remaining balances from you.

You are responsible for all charges incurred under your account, including applicable taxes, fees, surcharges, and purchases made by you or anyone you allow to use your account, or anyone who gains access to your account as a result of your failure to safeguard your username, password, or other authentication credentials or information.

Results not Guaranteed

The use of our data (first party and third party) is presented as a guideline for your interpretation, Cypherly makes no guarantee on your Service’s results.

Cypherly does not make any guarantees regarding your use of our Website or Service. Testimonials and examples provided/depictions on Cypherly’s Website, Service, or programs are examples of possible outcomes. There is no assurance or guarantee that you will see the same results in regards to increased income/Amazon ranking after using programs, products, or services provided by us.

Fair Use Policy

The Fair Use Policy (“FUP”) applies to the use of any tool, product or service offered by Cypherly, whether it’s provided directly or indirectly through another party to you. The FUP protects the interests of Cypherly’s clients and their customers, as well as Cypherly’s goodwill and reputation. By using our website, tools, products or services you agree with the provisions of this FUP.

Fair use includes the responsible use of all tools, products and services. Unusually high data, traffic, requests, products or keywords tracked which are outside the norm are considered unfair and can lead to measures as outlined below.

Cypherly reserves the right, by comparing the data, traffic, requests, products or keywords tracked use of clients, to ascertain, in its own judgement, if the usage of data, traffic, requests, products or keywords tracked is outside the norm and take measures as outlined below.

The measures Cypherly may take as a result of unfair usage of its resources may include any of the following, at Cypherly’s discretion: account cancelation and immediate termination of the services provided by Cypherly, as well as immediate termination of access to Cypherly’s platform; offering the user the option to pay for an additional monthly subscription to cover the costs on the base of fair use.

The FUP is subject to change and updated regularly.

Account Cancellation

If you would like to cancel your account, subscription or free trial you may do so by sending an email to support@cypherly.io. Please allow 3-5 working days for the cancellation to be processed. You will receive an email confirming the cancellation.

Authorization

The Services may integrate and/or interact with Third Party Platforms, including via APIs or browser extensions. For example, the Services may leverage APIs from Amazon.com., Inc., Amazon Services LLC and/or its affiliates (“Amazon”) to integrate with and interact with certain Amazon services, and/or Google Chrome browser extensions. The Amazon name and brand is a registered trademark of Amazon. The Google and Chrome names and brands are registered trademarks of Google.

Company has no affiliation, association, endorsement or sponsorship by Amazon, Google or any other third party platforms (collectively, “Third Party Platforms”). It is your responsibility to analyze and interpret any third party terms of service applicable to your use of the services (collectively, “Third Party Terms”), and you acknowledge that we have no control over, and are not a party to, such terms.

Without limiting the generality of the foregoing, you acknowledge and agree that in order for the services to work with certain Third Party Platforms, such as Amazon’s Marketplace Web Services, you must grant us access to your applicable third party account(s), such as your Amazon seller central account for Amazon’s Marketplace Web Services. By incorporating Third Party Platforms into your account with us, you authorize us access to collect, analyze and use data collected by or via Third Party Platforms (“Company Data”), including, without limitation, customer data (“Your Customer Data”).

You represent that you have the rights to access any applicable Third Party Platforms, and that you are an owner or authorized user of the Third Party Platform accounts you authorize us to incorporate. You further agree and acknowledge that we do not own or operate such Third Party Platforms and we are therefore not responsible for the operations, security, or performance of such Third Party Platforms or Company Data provided thereby.

Certain content on the services may be supplied by third parties. Any opinions, advice, statements, services, offers, or other information that constitutes part of the content expressed or made available by third parties (including other users) are those of the respective authors or distributors and not of Cypherly. You may enter into correspondence with or participate in promotions of such third parties, such as advertisers promoting their products or services. Any such correspondence or participation, including the delivery of and the payment for products, services or content, are solely between you and each such third party. Cypherly neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, submission, posting, or statement made on the Services.

As a convenience to you, the services may provide links to Third Party Platforms and their contact information, such as social-media handles and email addresses. Cypherly makes no endorsement of such third parties, nor any representation or warranty regarding anything that takes place between you and any such third parties. Third Party Platforms are independent from and not controlled by Cypherly, even if, for example, a company link or logo appears on a platform linked from the Services. It is up to you to read those third party sites’ applicable terms of use, privacy, and other policies.

By using the services, you hereby release Cypherly from, and waive any and all claims or claim rights that you may have against Cypherly, and release and indemnify Cypherly against any claims that any third party may have against us, arising from or related to (i) your use of any Third Party Platforms, including if accessed or used via our services, and (ii) Third Party Terms, applicable privacy policies or any other rules or regulations of such third parties entered into by you or applicable to you.
